I acknowledge that I have voluntarily applied to participate in the above ride (or any other trip to which I may subsequently transfer), and with the knowledge that there could be numerous risks involved including, but not limited to, climatic conditions, including excessive heat, fire, heavy rains or flooding. High humidity, illness, injury, insect bites, food poisoning, animal or criminal attacks, physical exertion for which I may not be fully prepared; all forces of nature, civil unrest or terrorism; breakdown of equipment, high altitude, accident or illness and the possible lack of access to prompt medical treatment or evacuation; the adequacy of medical treatment obtained or provided, or negligence on the part of Sea Hill Mountain Company Ltd (trading as Sea Hill MTB)

I understand and acknowledge that Sea Hill MTB does not own any entity which is, to, or does provide goods and services for this trip, including accommodation, transportation (other than the provision of bikes and food or drink). As a result, Sea Hill MTB, or any employees, shareholders, associates, affiliates, directors or agents, is not liable for any negligent or wilful act of such suppliers of goods or services, or failure to act of any such person, or of any other third party.

I agree to follow all written or verbal instruction given by Sea Hill MTB personel relating to safety and direction. I acknowledge that the enjoyment and excitement of adventure travel is partly derived from the inherent risk taken over and above those generally accepted in normal life and work practices, and that these inherent risks (contributing to the enjoyment and excitement), being a reason for my participation on this tour. I HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN WELFARE. I ACCEPT ANY AND ALL RISKS OF DELAY, ILLNESS, UNANTICIPATED EVENTS, INJURY AND TRAUMA OR DEATH, except where caused negligently or wilfully by Sea Hill MTB.

I acknowledge that the cost of the trip provided by Sea Hill MTB is based upon trip participants executing this Release of Liability and Assumption of All Risks. Therefore, as lawful consideration of being able to participate in this trip, I hereby RELEASE AND DISCHARGE SEA HILL MTB FROM AND AGAINST ANY AND ALL LIABILITY ARISING FROM MY PARTICIPATION IN THIS TRIP except where liability arises as a consequence of negligence on their part.

I agree that this release form is legally binding upon me, my heirs, successors, assigns and legal representatives, it being my intention to assume full responsibility for my participation on this trip, and to release Sea Hill MTB of any and all liabilities to the maximum extent permitted by law.

I understand that Sea Hill MTB reserves the right to refuse any person the right to participate in the ride, it judges to be incapable of meeting the rigors and requirements of participation in the activities. I also acknowledge that I will not be allowed to participate in the trip unless I wear the safety helmet provided by to me by Sea Hill MTB, and that any or all other protective clothing or equipment is not provided on this trip.

I acknowledge and agree that Sea Hill MTB reserves to right to film or photograph any or all elements of this tour, and solely owns the intellectual rights to such materials, and that they reserve the right to use such film or photographic mediums for promotional or commercial purposes, as well as approve such use of the materials by third parties with whom Sea Hill MTB may jointly engage in marketing or promotions, without any remuneration to me. I hereby assign all right, title and interest I may have in, or to, any media in which my name or likeness may be used by Sea Hill MTB to them,

I acknowledge that I have been provided with, and read and understood the Booking Conditions, and that I have full travel and personal injury insurance, and that any or all potential risks associated with this trip are covered under these policies.
